Giuseppe Pisanelli Bust

Giuseppe Pisanelli worked on a problem that military unification could not solve by itself: which laws should govern the new Italian state? The formerly separate states had their own legal arrangements, and common rules required choices about what to preserve and what to replace.

Born in 1812 in the Salento, Pisanelli was a lawyer and a participant in the political struggles that brought him into exile before unification. He later served as minister of justice. His work contributed to the Civil Code of 1865 and to the preparation of civil procedure legislation.

Civil law regulates matters such as property, family relationships, and obligations between people. Civil procedure governs how disputes about those matters reach and move through a court. Distinguishing them makes the scale of the codification project easier to understand.

The codes were collective legislative products, even when associated with a prominent minister. Pisanelli’s career shows how state-building continued through drafting and parliamentary argument after borders had changed. He died in Naples in 1879.
