Enrico Pessina Bust

Enrico Pessina’s legal writing examined the reasons a state could claim the right to punish. His Elementi di diritto penale became an influential teaching work, joining the rules in force to broader questions about duty and responsibility. Criminal law, for him, required philosophical argument as well as knowledge of statutes.

Born in Naples in 1828, Pessina passed through political opposition and exile before taking roles in the institutions of unified Italy. He combined university teaching with service in Parliament and government, including the Ministry of Justice.

His career overlapped with the rise of theories that sought to explain crime through biological and social characteristics. Pessina engaged with new ideas but resisted reducing the legal question of responsibility to those explanations alone. The relationship between law and the human sciences remained contested.

Later editions and manuals adapted his teaching to changes in Italian legislation. The bust commemorates a scholar whose work was used by successive generations of students, rather than the author of one isolated reform. He died in 1916 after a career spanning much of the liberal state’s history.
